Before you start

  • List your markets and classes. Registers are territorial, so decide which countries you'll sell in and roughly which goods or services classes fit your product before you ask.

Limitations of using Claude for trademark searches

Clearing a name means reading current register entries and applying a legal test that goes far past matching spelling. Claude on its own struggles with both, in six ways.

  1. Register changes after the cutoff are invisible. Claude's training data stops at a cutoff date that varies by model, and Anthropic says events after that point may be unknown to it (Anthropic). An application filed or abandoned since then won't show in an answer from memory, and Anthropic also notes Claude can occasionally give incorrect or misleading responses (Anthropic). Verify any registration number against the register itself.
  2. Conflict isn't about exact spelling. According to the USPTO, marks can be confusingly similar if they share sound, appearance, meaning or overall commercial impression, and the relatedness of the goods or services also decides a conflict (USPTO). Checking only the identical name leaves most of the risk unexamined.
  3. Filings still in examination matter. USPTO examiners search both registered and pending marks, and an application filed earlier for related goods can block yours if it proceeds to registration (USPTO). Brand pages and press coverage seldom mention pending applications.
  4. Use alone can create rights. US common-law rights arise from using a mark in commerce, and someone's prior use can narrow the protection a later federal registration offers (USPTO). The UK protects some unregistered marks through passing off (UK IPO).
  5. Each registration is territorial. A mark is protected only in the countries or regions where it's registered (WIPO), so finding nothing in the US tells you nothing about the EU or Australia.
  6. Clearance takes more than registers. The USPTO's checklist for a comprehensive search covers federal and state registers, domain names, international databases and the general web, and it says an attorney can run that search, interpret it and advise you on filing (USPTO).

How it works

Coverage limits

  • Four registers. Coverage is the US, UK and Australian offices plus WIPO's database. A full clearance search would also review state registers, domain names and names in use without registration, and none of those are here.
  • Uneven tools across registers. There's no UK IPO word search, so get the UK number from WIPO first, and the owner search returns UK national marks only. WIPO's collections refresh on their own schedules, which its coverage tool reports.
  • No legal advice. A register result is a record of filings. A qualified trademark attorney is the person to say if a close mark is a genuine conflict and whether the name is yours to use or register.
