Before you start

  • Decide where you'll sell. Each register covers its own territory, so list the countries before you ask, and know roughly which goods or services classes your product falls in.

Limitations of using ChatGPT for trademark searches

A name check depends on current register records and on a legal test that goes well beyond spelling, and plain ChatGPT has trouble with both. Six problems stand out.

  1. No view of today's register. Without a tool, ChatGPT works from whatever its training data held, so an application filed or abandoned since then is invisible to it, and it can still answer with confidence. OpenAI also lists made-up facts and references among the errors it can produce (OpenAI). A registration number in a chat answer needs checking against the register.
  2. Identical names aren't the test. The USPTO says two marks can be confusingly similar when they look, sound or mean alike, or leave a similar commercial impression, and that whether they conflict also depends on whether the goods or services are related (USPTO). Asking "is this exact name taken?" misses most of the risk.
  3. Pending applications count. A USPTO examining attorney searches registered and pending marks, and an earlier-filed application for related goods can lead to a refusal of yours if it registers (USPTO). Web pages about a brand rarely mention filings still in examination.
  4. Rights can exist without a registration. In the US, common-law rights come from using a mark in commerce, and earlier use can affect what a later federal registration gives you (USPTO). In the UK, some unregistered marks are protected through passing off (UK IPO).
  5. Protection stops at the border. Trademarks only cover the countries or regions where they're registered (WIPO), so a clean US result says nothing about Australia or the EU.
  6. A register search isn't clearance. The USPTO's own list for a comprehensive search runs from federal and state registers to domain names, international databases and general web searches, and it notes that an attorney can run the search, interpret it and advise on filing (USPTO).

Coverage limits

  • Not legal advice. A register result shows what is on file. Whether a similar mark is a real conflict, and whether you can use or register a name, is a question for a qualified trademark attorney.
